Pittsburgh Escorts: Judge nixes new death trial for Pa. mass killer

September 26, 2011

The crux of Roberto’s appeal was attacking Welner’s trial testimony that Baumhammers was an alcohol-dependent malingerer who suffered from delusional and narcissistic disorders and had anti-social tendencies — but wasn’t motivated by those disorders — when he shot the victims and defaced two synagogues in several Pittsburgh suburbs on April 28, 2000. Roberto noted that Welner, in three interviews since 2007, was quoted as saying Baumhammers was “schizophrenic” even though he testified at trial that Baumhammers suffered from less serious disorders that didn’t drive his behavior.
Welner explained this week that he simply misspoke about the diagnosis because he hadn’t reviewed his case file since the trial, and that his opinion about Baumhammers hadn’t changed.
Roberto also tried to suggest that Welner was lying and really had changed his mind because he remembered other details about the Baumhammers case, so why not the diagnosis?
As just one example, Welner recalled that Baumhammers was hiring women from escort services in the weeks before the shooting, and noted that 13 of his 19 cell phone calls during that time were for such purposes.
